Who can be detained?<\/span><\/p>\n<ul>\n<li>A foreign national or permanent resident.<\/li>\n<li>What are the grounds for detention?<\/li>\n<li>The CBSA may want to detain a person who:<\/li>\n<li>Is unlikely to appear for an examination, hearing or removal,<\/li>\n<li>Is a danger to the public or has violated human or international rights, or<\/li>\n<li>Has not established his\/her identity.<\/li>\n<li>Is inadmissible for security reasons or violating human or international rights,<\/li>\n<li>Serious criminality, criminality or organized criminality.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span class=\"red\">2. Why does the ID review the grounds for detention?<\/span><\/p>\n<p style=\"text-align: justify;\">The ID reviews the grounds for detention to ensure that the person is not detained without sufficient reasons, and that the situation which led to the detention still exists.<\/p>\n<p style=\"text-align: justify;\"><span class=\"red\">3. When does the ID review the grounds for detention?<\/span><\/p>\n<p style=\"text-align: justify;\">When a person is detained by the CBSA, the ID carries out a review:<\/p>\n<ul>\n<li>Within 48 hours of the start of detention or without delay afterwards.<\/li>\n<li>Then within 7 days of that first review.<\/li>\n<li>After that, the ID reviews the grounds for detention at least every 30 days.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">These timeframes do not apply to designated foreign nationals where a different detention scheme applies.<\/p>\n<p style=\"text-align: justify;\"><span class=\"red\">4. What happens then?<\/span><\/p>\n<p style=\"text-align: justify;\">Based on the evidence and the testimony of both parties (CBSA and the person concerned), the ID may:<\/p>\n<ul>\n<li>Order the release of the person detained, with or without conditions, or<\/li>\n<li>Maintain the detention.<\/li>\n<\/ul>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text]<\/p>\n<p style=\"text-align: justify; font-size: 12px; color: grey;\">Avoid the refusal of your application due to filling of the forms without knowledge of the law.
